Milton’s Town Council has approved a by-law that will change how you buy fireworks.
On Monday, November 13th, Council approved Fireworks By-law 089-2023. It prohibits the sale, distribution and discharging of consumer fireworks.
The Town of Milton described consumer fireworks as “powerful pyrotechnic devices that have the potential to cause injury, noise disturbances, property damage and emergency response.” A report presented to Council on October 23rd found that less than 1% of properties in urban Milton could potentially meet the clearance requirements needed to safely discharge consumer aerial fireworks.
The American Pyrotechnics Association (APA) defines consumer fireworks as:
“Also known as 1.4G fireworks. Fireworks that are intended for use by the consumer. The permitted usage of consumer fireworks varies… Examples are fountains, cones, and firecrackers.”
In contrast, display fireworks are defined as:
“Formerly known as special fireworks – Large fireworks articles designed to produce visible or audible effects for entertainment purposes by combustion, deflagration, or detonation.”
Display fireworks are still permitted as long as the by-law requirements are met, a discharge permit is issued by Milton Fire & Rescue Services (MFRS) and the fireworks are discharged by a licensed display supervisor.
“While Council understands the significant role fireworks play in celebrating key events throughout the year, we continue to receive complaints from residents who are frustrated by the late-night noise disturbances,” says Milton Mayor Gord Krantz. “This new by-law ensures our residents can enjoy the magic of fireworks in a controlled and safe manner.”
The new by-law is now in effect, which means violators could be subject to a fine as per the Provincial Offences Act.
